Right of Way & Excavation Permit
If you’re planning to dig, build, or do any kind of work in the street, sidewalk, or other public space, you’ll need a Right of Way permit from the City of De Soto before getting started. This helps us keep everyone safe, minimize disruptions, and protect public infrastructure.
When Do You Need a Permit?
You need a Right of Way permit for:
- Any work taking place in the public right of way (like streets, sidewalks, and medians)
- Utility installation or repair
- Lane closures or traffic control that impacts collector or arterial roads
- Sidewalk or curb replacement (outside of your own driveway)
- Temporary use or obstruction of the public right of way
How to Apply
- Complete the Online Right of Way Permit Application – Include full details about the work you're planning.
- Upload your Certificate of Insurance – make sure it meets these requirements:
- $1,000,000 General Liability (per occurrence)
- $2,000,000 General Liability (aggregate)
- Certificate Holder must be listed as:

- Upload a $2,000 Maintenance Bond (if required) – This is required for most excavation work except the following: driveway replacement, a residential street approach, or landscaping.
- Attach a Scope of Work and Site Plan – Show us what you’re doing and where—especially if you're installing new utilities.
- Upload a traffic control plan (if needed) – Required for work that will affect traffic on a collector or arterial road.
- Upload your Certificate of Insurance – make sure it meets these requirements:
- Submit for Review – We’ll review your application and documents. We may ask for edits or more information.
- Pay the Permit Fee – Once approved, you’ll receive an invoice for payment. If your project is longer than 1,200 linear feet, additional permits and fees may be required.
- Wait for Confirmation and Permit Activation – Once your payment is received, the permit becomes active and you may begin work. Do not start work until you’ve received confirmation that your permit is active. Starting early will result in double permit fees.
